For CNC machine tool spindle reconditioning services provided by Polski Serwis Wrzecion Sp. z o.o.
This translation is for information only. The binding version is the Polish original: Ogólne Warunki Gwarancji.
01General provisions
- These General Warranty Terms (the “Terms”) set out the rules for granting a quality guarantee (warranty) for CNC machine tool spindle reconditioning services provided by Polski Serwis Wrzecion Sp. z o.o., hereinafter referred to as the “Warrantor”.
- Customer – a natural person conducting business activity, a legal person or an organisational unit without legal personality that has commissioned the Warrantor to recondition a spindle.
- The warranty is granted in accordance with Articles 577–582 of the Polish Civil Code (Kodeks cywilny).
- The warranty covers only the components and work indicated as performed or replaced in the Inspection Report (Protokół Kontrolny) drawn up by the Warrantor for the given spindle and containing the spindle number, the order number and the detailed scope of the reconditioning carried out. The Inspection Report is the only document that defines the scope of the warranty.
- The warranty is valid in the territory of the Republic of Poland, unless the parties agree otherwise.
- Placing an order for a spindle reconditioning service constitutes the Customer’s acceptance of these Terms. These Terms form an integral part of every contract concluded between the Warrantor and the Customer.
02Warranty period
- The warranty is granted for a period of 6 (six) months, counted from the service completion date stated on the VAT invoice issued by the Warrantor.
- The warranty period begins on the service completion date stated on the VAT invoice, but no later than 14 days after the Customer has been notified that the spindle is ready for collection.
- A warranty repair, replacement of parts or repeated reconditioning of the spindle under an accepted claim does not start a new warranty period or extend the original warranty period. The warranty is valid only until 6 months have elapsed from the service completion date stated on the VAT invoice documenting the original reconditioning.
03Scope of the warranty
The warranty covers:
- correct performance of the reconditioning,
- correct assembly of the replaced components,
- the quality of the parts used,
- correct balancing of the rotating assembly performed during the reconditioning,
- retention of the geometric parameters obtained during the final inspection,
- removal of defects resulting from improper performance of the service.
04What the warranty does not cover
The warranty does not cover damage caused by:
- a collision of the tool or the workpiece,
- overloading of the spindle,
- operation beyond the permissible parameters specified by the manufacturer,
- the use of unbalanced tools or tool holders,
- improper clamping of the tool,
- improper transport or storage,
- flooding, or contamination with coolant, dust, chips or other foreign matter,
- improper lubrication,
- improper cooling,
- incorrect supply voltage,
- damage to the inverter, servo drive, encoder or other machine tool components,
- vibration or misalignment of the machine,
- mechanical damage occurring after collection of the spindle,
- normal wear and tear.
05Customer’s obligations
The conditions for maintaining the warranty are:
- installation of the spindle in accordance with the machine tool manufacturer’s documentation,
- ensuring correct cooling and lubrication,
- the use of tools and tool holders that meet the machine tool manufacturer’s requirements,
- keeping the spindle taper clean,
- observing the permissible rotational speeds,
- stopping operation immediately after noticing any worrying symptoms, such as:
- increased noise,
- a rise in temperature,
- excessive vibration,
- deterioration of machining quality,
- machine tool alarm messages.
- making the alarm history, machine logs and other operating documentation relating to the spindle’s operation available to the Warrantor at its request. Refusal or inability to provide such data may constitute grounds for rejecting the claim.
Continued operation despite the occurrence of the above symptoms may constitute grounds for rejecting the claim with regard to damage aggravated by further operation.
06Loss of warranty
The Warrantor may refuse to accept a claim in the event of:
- disassembly of the spindle by unauthorised persons,
- breaking of the warranty seals,
- repairs carried out by third parties without the Warrantor’s consent,
- design modifications,
- the use of parts not approved by the Warrantor,
- removal or alteration of the spindle’s identification numbers.
07Submitting a claim
- A claim must be reported without undue delay after the defect is discovered (by e-mail to biuro@pswrzecion.com).
- The claim should include:
- the order number,

- a description of the defect,
- the date on which it occurred,
- the contact details of the person submitting the claim.
- The Warrantor may request additional materials, in particular:
- photographs,
- recordings,
- the machine tool alarm history,
- information on the operating conditions.
08Handling of claims
- A claim will be considered on condition that the complete spindle is delivered to the Warrantor’s registered office.
- The Warrantor carries out an expert assessment that includes, in particular:
- geometric inspection,
- mechanical inspection,
- assessment of the condition of the bearings,
- inspection of the seals,
- electrical measurements,
- analysis of the causes of the damage.
- The claim will be processed within 14 working days of delivery of the complete spindle, unless the nature of the damage requires additional testing. In such a case, the Warrantor will inform the Customer of the expected completion date of the assessment.
- Exceeding the deadline referred to in paragraph 3 does not mean that the claim has been accepted.
09Fulfilment of the warranty
If the claim is accepted, the Warrantor will, at its own discretion:
- remove the defects found,
- carry out the reconditioning again,
- replace the defective components,
- refund the fee for the service if the repair proves impossible or economically unjustified.
The choice of how the warranty is fulfilled rests with the Warrantor.
10Transport costs
- In the case of an accepted claim, the costs of transporting the spindle are borne by the Warrantor.
- In the case of a rejected claim, the costs of transport and of the expert assessment carried out are borne by the Customer in accordance with the applicable price list.
11Limitation of liability
- The warranty covers only the spindle reconditioning service.
- The Warrantor is not liable for:
- production downtime,
- lost profits,
- loss of production,
- loss of technological data,
- indirect damage,
- damage resulting from the failure of other machine tool components.
- The Warrantor’s liability is limited to the value of the reconditioning service performed.
- The limitation of liability referred to in paragraphs 2 and 3 does not apply to damage caused intentionally or through the Warrantor’s gross negligence.
12Final provisions
- Any disputes arising from these Terms will be settled by the common court having territorial jurisdiction over the Warrantor’s registered office.
- Matters not regulated by these Terms are governed by the provisions of the Polish Civil Code.
- The invalidity of any provision of these Terms does not affect the validity of the remaining provisions.
